
When CNN met Frances Herbert and Takako Ueda this summer, they were newlyweds - legally married in Vermont - but worried that Ueda would be required to return to her native Japan.
The Defense of Marriage Act prevents the federal government from giving them any benefits, so Herbert can't sponsor Ueda for a green card.
Just this month, the government denied Ueda's application to remain in the United States.
The government sent a letter denying their application and stating that Ueda is "required to depart the United States within 30 days from the date of this decision."
"We know that, ultimately, this wrong will be corrected, and we are committed to working for ourselves, and other families, until it is," said Herbert and Ueda, who first met in 1980. "All any of us want is the ability to protect our families and the freedom to live our lives with the loved ones we choose."
New York immigrant same-sex married couple won't be deported
The organization representing them, Immigration Equality, plans to appeal the administration’s denial of their application, and will continue to work with their Congressional representatives to stop Ueda's deportation.
Although a Senate panel passed a vote to repeal the Defense of Marriage Act last month, it was considered a symbolic vote - there was no chance for the repeal to pass a Republican-led House.
“There has been no change in policy with regards to deportation cases affected by the Defense of Marriage Act," U.S. Immigration and Customs Enforcement spokesperson Gillian Christensen said. "Pursuant to the Attorney General’s guidance, the Defense of Marriage Act remains in effect and the Executive Branch, including DHS, will continue to enforce it unless and until Congress repeals it or there a final judicial determination that it is unconstitutional."

What's all the fuss about? There are hundreds of cases of "straight" couples getting married – to keep the one with a visa in the country – only to be denied & deported. It's against the law to marry for that reason alone... it's called fraud.

Marrying a foreign national does not grant automatic citizenship. For example there are many service members who meet their wife\husband while serving in foreign countries. The foreign born spouse still needs to go through the immigration\naturalization process.

Since others here have mentioned the affects gay marriage could have on children, I thought I'd chime in. I am a married, straight mother of 3 lovely kids. When they grow up, they should have the legal right to marry the person of their choosing regardless of gender. I want that for everyone. Gay rights are about human rights–they affect all of us. It is absolutely perverse to put obstacles in the way of people legally committing and sharing their lives with one another. We need more love and commitment in the world, not less.
I have been in this country LEGALLY for over 10 years, NOT breaking any immigration laws and not VIOLATING the terms of my student and work visas. In other words, I did not OVERSTAY like you did. And I'm STILL languishing in a LONG waiting list for a green card, despite having a doctorate degree and family ties. Why should you be bumped to the front of the queue?

Sure there is fraud, but the purpose of a spouse of a US citizen not having to wait for a visa number is to keep families together. If a couple has been married less than 2 years, then the alien spouse gets a 2 year green card and both the husband and wife must apply to have the conditional status lifted from the alien spouse's green card in the 90 day period before the second anniversary of the alien spouse's admission to the United States. This generally requires evidence that the couple have actually been living together as husband and wife during the two years. I had to go through this with my wife. It's a good thing. It's probably kind of hard to PRETEND to be married to someone for 2 years. Immigration laws should not separate families.

Yes, the law is the law... In fact US law used to permit humans enslaving other humans as well. Fortunately, we have evolved as a society, and realize that this law had to be abolished on human rights grounds, even though slavery was advocated in the Bible and was the backbone of the economy in the South.
Similarly now, we as a society from time to time re-assess the relevance and value of our laws, and abolish the ones that don't serve our country's interests. I have a neighbor who married a girl from chile but was unable to bring her back to this country. He had to live there for over a year before she was able to get whatever permit is needed to get into this country. Everyone should follow our immigration laws and there should be no exceptions. Do it legally and that goes for all those here illegally.

Uh – the DoMA was Bill Clinton's initiative, put into effect by him via Executive Order. It was then taken up by Congress and passed into Federal law, with the wide support of Democrats. It has survived during the recent two years of Democrat control of both the White House and both houses of Congress. Like Clinton's original version, it could be undone tomorrow by Executive Order if Obama chose to do so.

The Immigration Court here was considering whether she could stay...in this set of facts, there is not eligible relationship for the Immigration Judge to set aside an Order of Removal.
Don't conflate the actual facts of this case with cultural or political opinions/policies.
Here, the court followed the law which said that this person cannot legally enter the US despite "trying to enter legally" because she did not meet the elgibility requirements. If this woman was actually making efforts to immigrate legally, there would be no problem with her continued residence.
But the unintended message is that if you try to go through the legal channels you are more likely to be deported than if you live under the radar illegally.
I guess your point of view depends on if you wish to live with an open heart and compassion, or condemnation, and the need to control the lives of others. In otherword the liberal or conservitive points of view. It is your choise.
I'm a law student and I want to practice Immigration law. What I often think is lacking in many of these discussions is that law is often not determined by compassion, but by what a majority of legislators think is politically feasible for them to accomplish, while still retaining their seats in Congress.
Here, while marriage is generally an eligible relationship for pursuing legal status, the Immigration laws explicitly restrict that relationship to that which occurs between a man and a woman. If you want to change the laws, lobby your elected officials. Until that point, the law will continue to be enforced, despite what some may believe to be immoral or unjust or whatever.
If she's here illegally, regardless of anything else, out she should go. Then, from wherever it is she belongs, she can apply to come back legally. Anything else illegal is prosecuted, so why not immigration crimes???

2. More importantly, regardless of Clinton's EO, DOMA is now a law, and the president CANNOT unilaterally overturn a law (see: PL 104-199). Obama can, and did, elect not to appeal a Circuit Court ruling, but it was the courts (as in plural, more than one negative ruling) that ruled the law illegal. And regardless of what rabid DOM types tell you, the president is obligated to defend the law, and he did, but he is under no obligation to appeal.

My cousin is married to a really nice Canadian lady he met in college when she was here on a student visa, and it took months of jumping through hoops and her finding a job that would sponsor her for a work visa for her to be able to stay here after graduation, even being married to an american and not having the DOMA issue the couple in this article has. The process is getting to be a joke really, I mean so many stipulations for doing it right, and hardly any recourse for those who don't.

At no point was any mention of her entering the country illegally made. She came here legally, and is attempting to gain permanent residency status while still here legally. It is a common practice among many LEGAL immigrants who are married to a U.S. citizen. You simply enter the country on a tourist visa (or visa waiver) and apply to adjust your status to a permanent resident.
The only thing that sets her application apart is that the federal government does not recognize her status as a married individual.

This is a marriage issue. My partner and I were legally married in Vermont and he was here in the United States – LEGALLY – on a work Visa. Unfortunately, the company he worked for downsized and he lost his job and is awaiting a deportation hearing. If "HE" was a "SHE" I would be able to be the sponsor and the there would be no deportation. Our justice system does not work if there is no equality within it.

According to the video, she was here on a visa which seems is about to expire. That being said, why didn't she apply for citizenship in the '80s when she was seeing her soon-to-be spouse at the time? Then again, who knows what her entire past-time story was as far as her ability to get citizenship goes.
Well said, yes we don't know her whole story as to why she hasn't applied for citizenship. But just because one marries US citizen doesn't make the foriegn national a citizen. I know first hand having married a foriegn national in her country and having brought her back to the states, it wasn't easy or fast. There is alot that goes into transitiioning to a US citizen. But yes the laws need to change, marriage is marriage and I was able to apply for my wife because we were married as any couple, like in this story, should be able to do.

The US has given amnesty to other people illegal here in the United States. It all comes down to politics. I know I said I would not post again, but here is to my brother in-law and his other half in Rio.
And people with H1B (I thnk) visas who come here to work are allowwed to stay when they meet and marry citizens so when a gay citizen has to fight so hard for his/her 'rights,' it's just not fair.

Growing up in a Republican house, a military father who served 28 years, myself being married to a beautiful woman and being straight and a Christian and a God fearing man, God is a God of Love and I don't believe anyone can say any difference. The one issue is, "How can someone say God hates or will punish one for loving another?" After, taking another look at my beliefs and unfounded racism towards gays, does not the bible say love one another? Why so much worry about gays wanting the same rights that I have with my wife? Why not allow them to sponsor one individual that they can prove that they are married and once they sponsor one, give everyone in the US to be able to sponsor one individual. Now, why can't they sponsor one like I could if I married someone from another country? I served 20+ years in the military to defend peoples freedoms, doesn't everyone have the right to happiness? What is this consider any different racism than any other? They are not harming anyone, matter of fact they are taking themselves out of the gene pool. People to love one another is what I was brought up in the church, love the person but hate the sin and only one person I was brought up to believe had the right to judge! GOD, the God of love! I have never thought that having hate and having a close mind is what God wants. Really, where does it hurt you personally? If you actually think about it and come up with one reason it will affect yourself then let your voice be heard, but remember our rights end when it infringes upon another!
Being military myself with 6 overseas assignments, we are told repeatedly that we have to obey the laws of our host country. I'm sure you have been told the same thing. I don't view this being about gay marriage, there is no doubt thier marriage is legal in some states. I see this as this couple don't like the fact that htey are being held to task to follow the immigration laws.
Last words on this subject, lets make laws that will make sense and apply to everyone and not just a specific groups!
Citizenship is not guarenteed by marrying a US citizen. Many hetero couples run into this same problem. This story is a daily occurence to many hetero couples, it only makes the news when it is a ghey couple. Give them equal rights and change immigration laws. But until then, there is more parody in the system than you think, and don't think that only same-s3x couples actually run into this.

If morality is left up to the whims of current social trends and "as long as nobody gets hurt" is our guideline, then our future is indeed full of many changes. The unacceptable behavior of 50the years ago is todays norm. The unacceptable behavior of today will be the norm in 50 years at the rate we are moving. If you base your moral compass on the socially acceptable thing, then prepare for it to ever expand.

I don't see this as being about gay marriage. I see it being about this couple not wanting to follow the rules. I my post, I am talking about a straight couple.
They have no alternatives, I don't believe in breaking the law but how would you like being separated from the one you gave your heart to. I would hate being away from my wife and daughter but luckily I married someone that is a citizen. But people cannot always control there hearts! If she is here ILLEGALLY, she needs to follow the rules and make herself legal to reside here. I have a friend living with his spouse aboard and he has to leave the country every 90 days to a country that will stamp his passport then return to the country they live in, getting his passport restamped and a new 90 days. He doesn't like but he is obeying the laws of the country they live in. That is what is demanded of Americans living all over the world, that they FOLLOW THE LAWS OF THE COUNTRY THEY LIVE IN!! Why should we expect anything less of the people living in the USA?

They were legally married in Vermont (a state) the state is not in charge of immigration. The federal government is in charge of immigration, and does not recognize the marriage. So as far as the dept in charge of immigration is concerned they are not married. That's one of the things DOMA is for.
And, that's one of the reasons DOMA should be repealed or invalidated.
If the marriage is legal....and it is....she should be able to get a green card....period.
Well, your insightful and well-educated take on immigration law notwithstanding, the article says that federal laws don't recognize gay marriages, so the citizen can't sponsor the immigrant for citizenship. Guess what? As far as the feds are concerned, it's not a valid marriage, regardless of how you feel.
And even if the US citizen could sponsor her 'wife,' there is not guarantee of approval for a Green Card.
If they were a hetero couple almost certainly they would not be in this situation. Toto and others keep saying there is no guarantee of citizenship in the case of hetero couples but it is almost certain. It isn't 100%, no, but pretty darn close so you are throwing out a false argument. This is outright discrimination against gay couples and very wrong.
She's not an illegal, she's just had the reapplication for her greencard denied. When they deny they deport. She could have gotten a speeding ticket and they would reject it. Man some people jump on the uptight bandwagon quick!
The denial is based on her being "out of status". Once you overstay a visa you have a choice. Go home with under a year elapsed and wait 3 years to come back OR stay longer and wait for 10 years.
Given her "herstory" – she will simply ignore the deportation order and go back into hiding.

It isn't illegal to deport a legally married person. The government can deny anyone they choose, the citizen spouse can always try to immigrate to the other country, you know. I know this, as it almost happened to me, someone who immigrated from Canada.

Well we don't really know what her life situation is as far as immigration goes; for all we know her immigration status may have expired.
Since when is every immigrant facing deportation an illegal immigrant? Don't jump to conclusions like that. That is a major problem with people in this country right now. Learn a little about something before you jump to your own conclusion.
By definition, being deported means you are being forcibly removed from the country for being here illegally. She either came illegally, or has now violated one of the conditions of her visa.

Having a work visa isn't illegal immigration. Also, according to the US laws on Nonimmigrant Visas, If you spend more than a few hundred days in the US, you are required to report/pay income taxes. She has been here 31 years and is supposed to be paying taxes. Whether or not she does, we don't know. But her status, until her un-employment, was perfectly legal. She is probably a part of the 53% of Americans that pay income tax. Are you in that group?
@Tonlok: I think your missing the technicality in your paragraph. She was here on a work visa, and became unemployed. That downside of that is what you typed, that you can't be unemployed for a long period of time and in the country on a work visa.
I think you believe others just wish she would disappear – most would love to see her be in this country legally if she would have done it by the rules. Now, it's just being against-the-grain and thinking you can just bully your way through guilt. It takes time to get citizenship, and work visas have it's pitfalls. This is it.
