Family says undocumented student killed himself over fears he'd never go to college

By Rafael Romo, Senior Latin American Affairs Editor

(CNN) - Joaquin Luna was only 18. The senior at Juarez Lincoln High School in Mission, Texas, dreamed of going to college. But since he was in the country illegally, that was nearly impossible.

Luna was quickly losing hope of ever going to college, his family says. The Friday after Thanksgiving, Luna put on a suit, kissed his family members, went into the bathroom and shot himself in the head, according to family members.

"He didn't see no other way or no other option," his brother Diyra Mendoza told CNN affiliate KGBT.

Mendoza found the body after hearing the gunshot.

"As soon as I pulled him out to the kitchen, I could see the bullet hole and there was no movement, no signs of anything," Mendoza said. "He was gone."

Mendoza says the letters his brother left behind reveal his fears about being in the country illegally. He also was frustrated because the DREAM Act - an initiative that would legalize young immigrants who have been in the country for more than five years if they attend college or serve in the military - never passed.

It's estimated that the DREAM Act would benefit about 2 million young people. It failed by five votes in the Senate last December. A new push by Democrats in Congress this year also didn't go far.

Illinois Sen. Dick Durbin, a Democrat, who has been pushing for the measure for a decade, testified at a congressional hearing in June. "The Dream Act would make America a stronger country by giving these talented immigrants the chance to fulfill their potential." Durbin said.

But Republican lawmakers call the bill "blanket amnesty" and have strongly opposed it. Sen. John Cornyn, a Texas Republican, calls it "a band-aid and maybe worse, it would provide an incentive for future illegal immigration."

The DREAM Act was also a hot-potato issue in the November 22 CNN debate of Republican presidential candidates. Former House Speaker Newt Gingrich spoke in favor of the DREAM Act. "I don't see any reason to punish somebody who came here at 3 years of age, but who wants to serve the United States of America," Gingrich said.

Mitt Romney agreed with Gingrich saying the he "would staple a green card to the diploma of anybody who's got a degree of math, science, master's degree, Ph.D. We want those brains in our country."

But Michele Bachmann denounced it, warning the measure would "offer taxpayer-subsidized benefits to illegal aliens. We need to move away from magnets not offer more."

Back in Texas, Mendoza is thinking of other young immigrants like his brother. "It's like all these kids that are here. They're all dependent on that DREAM Act to keep on studying," Mendoza said.

But with a Congress unable to reach a compromise to reduce the deficit and presidential elections less than a year away, the chances of any immigration bill being passed seem unlikely.

Did this young man kill himself because he was an illegal alien, or because he was mentally ill? We have lots of illegal aliens attending state colleges here in California who are quite open about their status. So the immigration status of this young man and his family are not relevant. Case in point- were the parents of this young man deported? I thought not. Deportation was never a threat for this young man. Therefore, immigration laws did not kill him. He killed himself.

I couldn't agree more-there are many variables here and this story is slanted in favor of The Dream Act. I know for a fact MANY individuals with illegal status attend college in Texas!

A lot of American teens kill themselves over personal problems. He was 18 – An adult. No longer "a child."

I don't see every other teenager that actually ARE children with real problems making news headlines. A LOT of people in America, even those who have lived here for generations, don't make it into college.. for whatever the reason. And they don't all run off and kill themselves.

I think it may be a safe assumption that this teen had other problems as well.

I was just thinking about how many of my child's classmates we hoping for an athletic scholarship of some kind. Most of them did nto receive such a scholarship. So plan B is to go to the local junior college and work hard, apply for scholarships and then transfer to a 4yr university. They didn't give up and commit suicide. I blame the family, they shouldn't have been here to begin with! And they certainly didn't seek out a legal means of immigrating here. It is totally their fault. They've lived here in violation of the law all this time. Damn shame this young man is gone, they share the greatest portion of the burden for that tragedy.

If illegal immigrants stayed in their own country and struggled and fought to right the wrongs in their own country, their country would eventually be a better place. I was unjustly branded as an enemy of America even though I was a citizen of this country and my grandfather was a naturalized U.S. citizen. But my dad said, "Right or wrong, my country. If you see the wrongs, stay in your country and fight to right those wrongs. Don't run away from your country." I stayed and fought for my rights as a U.S. citizen and am glad that I did. America is worth fighting for. Thanks, Dad.

The same way the Chileans fought and voted for their communist leader? You know, the same one the CIA helped assasinate on September 11th, 1973 and helped murder 3000 Chileans that day.

Venezuela has a very unpopular leader, but he was elected and our government attempted to assasinate him. There is a Communist Movement in Chile again and its the College youth......will they get a chance to fight for THEIR choices or will our Government once again step in for the love of Corrupt Capitilst?

Its easy to say that they should fight for their own countries.......but when this country takes a shyt on the rest of the world, it makes it harder.

There are colleges in Mexico and Latin America, but if you think a little harder, they would have to start from elementary because they don't have the proper education to just enter a college. American diplomas don't transfer to other countries, they still have to learn the language, reading and writing along with the culture and history.

If we staple a green card to every Masters or Ph.D. degree awarded to illegal immigrants, don't we get MORE TAXES because now these people with 70k to 100k jobs now have to pay taxes to the U.S.? Why shouldn't we give taxpayer-subsidized benefits to present and future taxpayers?

Maybe if there was an excess of jobs in the US. Unfortunately, many people with Masters cannot find jobs right now, so the illegal immigrants who graduate would just make the unemployment rate higher. It would also be harder for legal residents to get a job paying that amount.

there is certainly a shortage of 'common' jobs in this country; but there are actually employers who are having trouble finding qualified candidates for more skilled/technical positions - engineers, for example. so whether or not an individual would raise unemployment would come down to what degree they chose to pursue.

Not necessarily. How many will "go home" after they finish their degree. And Masters and Doctorates are a long way down the road. Not everyone gets into a Master's and fewer a Doctoral. There are plenty of "legals" that want to come into this country for a Masters/Doctorate so there is no need to "hellp" anyone illegal. The issue is – we a are a country of laws, and entering this country is illegal – end of discussion.

What is really funny, ICE is draconian about Chinese Illegals. They deport them in a heart beat. What is interesting – they discourage Chinese immigration, and Chinese come here, pay there way. Name me one Chinese immigrant – legal or illegal that takes public assistance – doesn't happen. But strangely ICE has this strange bias to Hispanics.

He could still attend college in the US and there are also decent colleges in Mexico. He wouldn't be able to work legally in the US after graduating but with the employment situation being what it is he'd probably have better luck finding a decent job in Central or South America. Mexico - like Texas - is only a dump if you're poor and unskilled. This kid was let down not by the absence of the DREAM act but by being very badly advised.

Message for illegal Immigrants, Want to go to college, Do it when you are legal, All these illegal immigrants come here and expect everything for free and the ones that did come here legally had to pay. How many illegals does it take to sink a big boat. We are about to see!! The U.S. is sinking fast and when she's done than where are these immigrants going to go then?? Canada! and claim again that they were there first. Illegal immigrants here from their family and friends that they can come to the U.S. without papers and get everything they desire for free but it's really not free. The true American tax payer is paying good money out for that and yet the illegal immigrants call us racists and all that B.S. and yet we still throw them a life raft, Why? The government claims that immigration is good for business but yet those immigrants can't even take care of their on country, Just look at it, If these immigrants were so good than why is there country so bad especially when it's resource rich. The main point is you cant reward people for breaking the law. I have been working and living in latin america for 15 years totally legal. If I was working or living in latin america illegally I would be arrested and for sure sent home. Why should people be rewarded for breaking the laws in USA. There are many people standing in line trying to come to USA legally. Why should someone be given a pass ahead of those guys? I feel bad for the family but the kid didnt kill himself because he may not get into school.

This country needs immigration. We should be diverse. The problem is illegal immigration. My family came over here two generations ago. My grandparents were from Scotland. They came over here legally. They worked here legally. They followed the law to live here legally. A country should be diverse to help educate people against racist bigotry that you and many of the commentators on this page have displayed. No where does it say you would pay for illegals to go to college, only that they will have the opportunity. This means they have earned the right through years of working hard. I think universities should chose the smartest candidates, those who earned it. Birthplace is a matter of luck and it makes you no better of a person. The parents illegally enter the country along with the young child. The adults know what they are doing, not the child. Then the child grows around Americans and believes he's American until he's brought down to reality; that he will not be able to get the same freedoms and benefits his friends get for being citizens. So he informs himself (something the parents failed to do so). So he finds obstacles after obstacles, the Media feeding fear in one side and politicians demonizing his status in the other side. So now he's only choice is to go back to a country he doesn't relate himself, know little to nothing of the culture, language, system, you call it. Knowing he would start from zero somewhere else. What to do? Some people didn't ask for this, so what should happen to these kids or teens who bust their behinds in school and can be potentials to this country. The other side of the spectrum is understood as clear as the law, but we have to think and act on a fair solution to these dedicated, well educated people. Lets think!

We have law enforcement sent to silence legal citizens protesting the Wall Street corporate greed, but we cannot seem to get our government to remove illegal residents. The only reason all these illegal residents are still here is because of people who want cheap labor and our lousy, rotten politicians who want votes. I am sorry he killed himself. Always a tragedy. He should have tried to become a naturalized citizen and then gone to college.i

Michelle, I cannot believe that you are so twisted that you base all your arguments solely on emotion. Also the concept of "retribution of bad acts" are not confined to "Christianity garbage" but also tenets of Hinduism and Buddhism. A narrow mind is shown by confining all of one's arguments to the emotional. You are a prime example of the average American's incompetence and why companies must hire Indians to do more scientific and technical jobs. What 2 sides? Entering a country illegally is a crime. We are a nation of laws, and allowing people to only follow laws they like will very easily "burn" you and your ilk in the end. And wishing someone luck (hardly scientific) is typical of the perpetual underachiever. Successful people make their own luck. Who is the hick here Michelle? BTW- your use of the word comprende is totally incorrect – so it seems that you don't understand Spanish very well. Comprende is 3rd Person Singular – Present Active Indicative (basic grammar – hopefully you are not a hick and understand that) I believe you wish to use comprendes in the context you were writing. I wager you know very little spanish, just what you might hear on TV. As far as I am – being obviously more intelligent than you, obviously better educated (and politically incorrect with a passion) – I have learned the language spoken by the most of the world, that is Mandarin Chinese or Putonghua – don't worry they are going to own us very soon, and they don't tolerate stupidity on your level – hopefully you are attractive so you might fulfill some role under a Chinese manager – dong le ma?

My question is why there is no sympathy for us?? "Us" meaning the folks who have paid taxes our whole lives so that "our" kids can have the SAME opportunity to go to a good university, yet see them having to take a "back seat" to others who have not yet PAID THEIR DUES! I can understand sharing the wealth, but NOT when it means my kids have to accept giving up their seat to someone else!!!

Why do none of the stories about this make note that in the state of Texas, where this unfortunate incident occured, illegal immigrant children who graduate a Texas high school are eligible to recieve state financial aid, and are listed as residents for tuition purposes. This child definately had a chance to go to school in Texas. This is a terrible thing for him to have done, but I do not believe him not wanting to go to college, or the failure of the DREAM act to pass congress were the sole purposes of him ending his life. As a Texas resident, he would have known about being able to attend Texas colleges. I do not like illegal immigration, and some of the problems it causes, but it is terrible that some are exploiting this tragedy.

I've tried to teach quite a few in our community colleges and they, frankly don't give a d$$m, but they get the financial breaks.

I disagree. What's absurd is that the people who brought him here illegally didn't inform him on how to become an American citizen legally. This would have alleviated his concerns about his citizenship status and thus his fear of not being able to go to college. The solution is not to lessen the citizenship laws but to enforce them so that this kind of thing does not continue to happen.

    Joachin Luna
    Fulfilling a dream in waiting…

Dedication, effort and hard work has always been with my family, all done for us

children in order to survive in this world. At a young age we were taught to never give up in life

and to always keep moving forward no matter the obstacles we face. The toughest job I have

ever done was picking asparagus off the fields, in Big Rapids, MI. I still remember the hot sun

and the sunburns my family and I would acquire when picking the asparagus the wrong way.

That summer I struggled, it seemed like it was never coming to an end.

My motivation grew stronger as the season was coming to an end. I could see the

tiredness and anxiety in my family’s face. When it came to school my grades were good, but

since I started traveling to different states after my parents’ struggle in finding a job. Credit-wise

I wasn’t doing good as I started traveling most of the schools I went to didn’t offer any of the

classes they were offered in my previous ones. It was a major complication for me but thank god

I was able to overcome and accomplish everything needed in order to have earned every credit

necessary. When it comes to communication between my teachers, it progressed incredibly. I

started to be more outspoken and learn how to ask questions when necessary. I’ve set up goals

to become the first in my family to go to college and have fought hard to get to where I stand

now. For example, I plan in making it to at least top 25% of my graduation class would be one of

my most outstanding achievements if I fulfill to accomplish. Knowing that my older sisters

didn’t attend college gives me the encouragement to try my best and finish off what they

    couldn’t start.

One of my favorite and by far one of my strongest subjects is math. I’ve adapted to math

as a different language we need to understand to make it in this world. Since I have really good

impressions in the math field I have considered studying a career that deals with it. That is where

Architecture will fall under place for my perfect match. My vital goal is to become a successful

architect and help my family in any way possible the way they have always helped and been

    there for me.

If I had the financial requirements to pursue my goal there would be nothing more

standing in the way to achieve it. I have confidence that the C.A.M.P program can help me

become that person I’ve always dreamed of becoming. It would make a major impact in my

whole family especially to my parents who have struggled practically their whole life. They have

unconditionally supported me and will continue to do so for the benefit of my brothers as well. I

want to demonstrate to them that all that agricultural work done and all those days of giving their

best would have been worth it. The sound of being the first one of my family graduating from

college makes me want it more because I want to prove not only to myself but to many other

people especially my own sisters that even because we don’t have the financial support doesn’t

mean we need to quit in fulfilling want we always wanted to. That right there would really

    complete my dream.

this story is truly sad and my heart goes out to his family, but his family should have been LEGAL citizens. in other countries when people are immigrants they are put in jail among other various legal action. they should do more legal action to prevent illegal immigrants in the U.S. and things like this wont happen. the country is struggling enough, and some people work there asses off to live here LEGALLY.

With the education he'd gotten here, he could have returned to Mexico to go to college and then come back with the intent of getting citizenship and staying.

A LOT of US citizens pay their own tuition, he could have done the same thing.
There is more to this story than the media is sharing.

If everyone who didn't have a chance at a college education killed themselves, we'd have a lot of dead people who are here legally.

What do people do who can't go to college because they have to support their families or they can't hack it in college. I am sorry this happened but US citizens can't keep paying for all the people flooding into this country illegally. The more you let it go the more thousands enter the country illegally. Too many foreign nationals come into this country expressly to try to have their kids educated here and live here forever and its wrong. I am a liberal but we have to stop the flood of illegals. It is destroying our country.

I just left a public university in Texas after working there for 9 1/2 years. One thing I can assure you of, is that he would have had no problem going to college in Texas.

    1. Illegal immigrants are not barred in any way from attending colleges or universities in Texas.
    2. An illegal immigrant who lives in Texas at least 36 months prior to graduating from high school (or earning a GED) in Texas and the 12 months prior to enrolling in college is classified as a resident (not non-resident or international) for tuition purposes.
    3. An illegal immigrant who is classified as a resident for tuition purposes in Texas will receive financial aid from the State of Texas (but is ineligible for Federal aid).

So, this child could have attended a public college or university in Texas, paid the resident rate, and received State aid while doing so. The only thing that he could not have done would be to get a job (legally) in the U.S. after completing his education.

There's a lot more to this story that we're not getting, but the only thing the "Agenda Seekers" want us to know is, "He killed himself because we taxpayers wouldn't foot the bill for his schooling because mom & dad brought him here ILLEGALLY" I'd be slightly amused by this "Short Story", if not for the fact that a "Young-Man" is dead. I'm 150% positive, Not going to college on the taxpayers dime" is just a tiny (If any) fraction of the "Causal Affect" of whatever else was going on in this boys life (i.e. Home life). I'm for Immigrants! I say, "If your here legally, Welcome!" But if your part of the over 40,000,000 (thats MIllion) Illegals (citizens are given the low-ball number of between 12 to 15 million. Thats garbage! and if you go to the right places, you'll find the correct number on the web), I say.. We can no long afford this open door policies of the past, & the door has to be shut before we here in America are turned into another third world. But of-corse having said that, I know.. the door won't be shut because lobbyist have paid off our politicians to keep the door open.. & Slowly we are becoming a 3rd world country.

My heart goes out to the family, and may God comfort them.

Now, I wish to state that this article, in my view, does not seem to cover all relevant facts. My first question was, "why did this young man have a firearm?" I then looked up Texas gun laws, and in Texas, those 18 and over can purchase handguns without government registration, etc. So, technically, this boy was a legal firearms owner.

However – why would a young man kill himself over this? I am not judging him nor questioning his sanity (far from it), but if lived with his family and went to high school like any other normal teenager, the picture I get is that this young man was not hopeless – far from it! Sure, it would most certainly be heartbreaking not to be able to go to college due to his immigration papers, but was this really something to kill yourself over?

What I would like to know is: what were this boy's relationships with his parents like? Why are they scarcely mentioned?

I think there is more to this story. I'm not implying nor insinuating improper parenting, abuse, or what not. This young man did not need to do this. It's tragic all around. But the way this story is presented – it just leaves me asking questions.

    God bless this family.

As a Filipino who came here to the U.S. as a legal immigrant, I would say that this country, like EVERY OTHER COUNTRY IN THE WORLD, has a right to create immigration laws. Citizenship is only a right as long as you are born in this country. For everyone else it is a privilege. Just because someone supports immigration laws, it does not make them racist. If anything it makes them law-abiding citizens. Those who choose to break the laws are being ignorant. Those who want amnesty here in the U.S. act and talk as if the U.S. is evil for creating and enforcing immigration laws. Correct me if I'm wrong, but I believe every other country has borders and laws regarding crossing those borders. Are they evil too? If the laws are changed some day to allow illegals to apply for citizenship, that's fine with me as long as they go to the back of the line – the fair thing to do.

Fine .Easier said than done.Who is gonna pay for it?

Had the parents stayed in Mexico they would have had to pay for the books and uniforms to allow their child to go to school. Their school system is not set up the same way it is here, it's something you pay for, even the lower grades. And since most of the families live at, or below poverty level, paying for school necessities takes a back seat to utilities and food. Especially when they are living pay check to pay check... I'm sure many of us can relate to that. Imagine what we Americans would do if we were asked to pay for our childrens' schooling, It's easy to say go back to Mexico and go to school there, when you don't know anything about what kind of opportunities, or lack thereof, are available. There needs to be regulation but simply saying..."awe, sad story but get out of MY country" is ignorant and insensitive. Unless you can trace your lineage to some Native American tribe which migrated to this area, you too came from immigrants.

    • Tired of it all

American citizens DO pay for their child(ren)'s schooling... through their property taxes!!!!!!! We also pay for it through various other taxes when we vote for levies or bonds to support our districts. We also host fund raisers for our school's in order to make up for some of the major cuts made. Many public schools are starting to require uniforms – we also pay for those out-of-pocket. We're nickeled and dime'd to death for our child(ren)'s education and yet all the government can do is make cut backs, cut backs, and yet MORE cut backs in this department.

ILLEGALS put a drain on our school systems by requiring translators since 9 times out of 10 their first language isn't English. Because they fall behind due to the language barrier, they also need to add yet more Individual Education Programs (formerly known as Special Ed) which is yet another drain on the education for our legal children. With the IEP and lack of language skills, they also bring down the school's test scores for that stupid "No Child Left Behind" law – which is yet another drain on the school budgets 'cuz if the school's don't meet the standard scores, they lose funding. Many illegal families don't have a reportable income, so they get free lunches – which is yet another drain on our school budgets.

AMERICAN TAX PAYING CITIZENS and LEGAL TAX PAYING IMMIGRANTS PAY FOR IT ALL!!!!!!!!!!!

Pumnut – Sice you brought up Mexico – in MANY cases the governement gives support to families for the uniforms; since 1959 textbooks are free for primary and Jr. High school-even the private school students use these books! As mentioned by "Tired" property taxes pay for education in the US and the rate of NONpayment of property taxes where I live in Mexico is high (low income housing and most cars are new within the past five years!) paying H2O and electricity is minimal since generally the goverment will not cut these services. "Tired" is right-we Americans have fund raisers, etc when asked to pay more for our children's education.

Going to ANY country to improve one's stance in life is a PRIVELEGE, not a right. Follow the laws to do so! –I did when I moved to Mexico, which, at the time had immigration laws that were MUCH more difficult and expensive than those in the USA.

Asking someone the obey the laws that actually help America to function is not ignorant.

EXACTLY! There are many LEGAL citizens and immigrants who commit suicide for the same reasons as this story alleges, but we don't see them in the news for it, now do we? Nope. Very sad.... but hey – lets use this tragic story of a young man for a political grand stand just to push some buttons to get that Dream Act rolling again.

I'm really, really sorry this family lost a loved one – for any reason! But I seriously doubt the only reason this young man committed suicide was because he was afraid his dream of going to college may not be in his future. There are many other underlying factors to this story we're not hearing about.

    Sad? Absolutely.

But the fault? Being in the country illegally.

Who to blame? Well, I'd say whoever brought him into the country.

It certainly is not the fault of the U.S. government.

My wife and I have to send our kids to community college because we cannot afford the larger colleges, but we make a little too much to receive some of the loans that are available. The idea that illegal alien invaders to this country were going to receive any type of financial assistance whatsoever burns my blood.

It is a pity, but I won't shed any tears. Illegal alien invaders need to reconsider whether to stay here or go back and make their own countries better places to live.

Why don't we just tear down our borders and let everyone come over illegally, and if you stay here for a few years, hey congrats, we'll make you a citizen. This story disgusts me. I totally agree with you. In America and around the world, they want to blame American society for their failures, how many countries will allow and American to come in illegally and reside on taxpayers dime. Then yell, "It is because of America that I can not get a free ride to college!!!". If his family wanted to get him into school on a scholarship, or loan, they should have applied for his citizen ship. As a minority myself, I have worked my way to where I am without taking any hand outs, and I also have seen other people, From Mexico, whose parents may not have been legal but they found a way to get at least get their kids a green card so they can also take part in the American Dream like naturalized and born citizens, and that means to pay taxes like the rest to enjoy those freedoms. If his parents really wanted him to attend school get a visa then take part in the free programs to foreign students, but stop crying foul on the government and to people who are tired of carrying the illegal on their back, already pay assistance to all unmarried kid producing factories.

I have been in the US for 12 years and some change. I am better off than many of the immigrants that come to this country, but I am also looking for a better life for myself, my wife and our future family. I came to the US legally and worked hard to pay my way through college and pay for expensive visas. I did things the right way and it is not fair that illegal immigrants get automatic citizenships and I get to wait in line forever. In the end, yes, I am better off than they are, but ultimately I am looking out for my family, first and foremost and I am not willing to give up on that for the benefit of others who choose to come here illegally.
