Program granting work rights for childhood immigrants begins Wednesday

Starting Wednesday, people who arrived in the United States as children and without documentation can apply to work without fear of deportation, the director of U.S. Citizenship and Immigration Services said Tuesday.

"This afternoon, USCIS makes available online the forms and instructions for individuals who will request deferred action for childhood arrivals," USCIS Director Alejandro Mayorkas told reporters in a conference call.

The announcement comes two months after Department of Homeland Security Secretary Janet Napolitano announced that people who arrived in the United States as children may request consideration of deferred action for a period of two years subject to renewal, and would then be eligible for work authorization.

The program, dubbed Consideration of Deferred Action for Childhood Arrivals, was created in June under an executive order signed by President Barack Obama.

"Deferred action does not provide lawful status or a pathway to permanent residence or citizenship," Mayorkas said Tuesday.

The $465 application fee will fund the administrative costs of the program, including a biometric check and issuance of a secure work-authorization document, he said.

Each request will be examined for possible fraud, he said.

The forms and instructions are posted at www.uscis.gov/childhoodarrivals.

As many as 1.7 million youths may qualify for the program, according to the Pew Hispanic Center, a project of the Pew Research Center.

When he signed the order in June, Obama said the changes will make immigration policy "more fair, more efficient and more just."

The shift on the politically volatile issue of immigration policy has elicited praise from Latino leaders, while Republicans reacted with outrage, saying the move amounts to amnesty - a negative buzzword among conservatives - and usurps congressional authority.

"This is not amnesty. This is not immunity. This is not a path to citizenship. It's not a permanent fix," Obama said. "This is a temporary stopgap measure."

Noting children of illegal immigrants "study in our schools, play in our neighborhoods, befriend our kids, pledge allegiance to our flag," Obama said, "it makes no sense to expel talented young people who are, for all intents and purposes, Americans."

The president declared that the policy change is "the right thing to do."

Under the new policy, people younger than 30 who arrived in the United States before the age of 16, pose no criminal or security threat, and were successful students or served in the military, can get a two-year deferral from deportation and apply for work permits.

Participants must prove they have been living in the country continuously for at least five years.

The change is part of a department effort to target resources at illegal immigrants who pose a greater threat, such as criminals and those trying to enter the country now, Napolitano said.

The move addresses a concern of the Latino community and includes some of the provisions of a Democratic proposal called the DREAM Act that failed to win enough Republican support to gain congressional approval.

Obama has been criticized by Latino leaders for an overall increase in deportations of undocumented immigrants in recent years. Last year, U.S. Immigration and Customs Enforcement removed 396,906 illegal immigrants, the largest number in the agency's history.

Obama and Napolitano have called for Congress to pass the DREAM Act, which would put into law similar steps for children of illegal immigrants to continue living and working in the country.

Republicans who blocked Democratic efforts to change immigration laws have condemned the move, with some calling it an improper maneuver to skirt congressional opposition.

Rep. Steve King of Iowa, a GOP foe of Democratic proposals on immigration, threatened in June to sue to stop Obama "from implementing his unconstitutional and unlawful policy."

Republican Sen. Lindsey Graham of South Carolina has called the decision "a classic Barack Obama move of choosing politics over leadership," while House Judiciary Committee Chairman Lamar Smith, R-Texas, has called the change a "decision to grant amnesty to potentially millions of illegal immigrants."
Others predicted the move will tighten an already poor job market for young Americans.

However, Democratic Sen. Dick Durbin of Illinois, who sponsored the DREAM Act, said it "will give these young immigrants their chance to come out of the shadows and be part of the only country they've ever called home."

Presumed GOP presidential candidate Mitt Romney said in June that the issue needs more substantive action than an executive order, which can be replaced by a subsequent president.

As president, Romney said, he would seek to provide "certainty and clarity for people who come into this country through no fault of their own by virtue of the actions of their parents."

Latinos make up the fastest-growing immigrant population in the country, and the Latino vote is considered a crucial bloc for the November presidential election.
A spokeswoman for a major Latino group, the National Council of La Raza, hailed the administration's move.

"In light of the congressional inaction on immigration reform, this is the right step for the administration to take at this time," NCLR spokeswoman Laura Vazquez said in June.

      Actually, we have, as a group throughout history picked laws that weren't working and changed them... through directives, through civil actions, through the court and through the legislature. Rosa Parks decided that the law that made black people sit in a certain spot on the bus was problematic. Do you think she was a "lawbreaker" and should have been sent to jail? I'm pretty sure the answer is no (but it may be yes). This is another example of a serious challenge in our country, and a this is a solution. It's not perfect, but it is moral and just. When a police office lets me off with a warning instead of a ticket for speeding, she has exercised her reasoning allowed within the law. So too has our president in this case.

    This act by our president saddens me immensely. As one who has fought to help protect the way of life of America, I find it irresponsible of the president to side step immigration laws and to reward illegal behavior. It is time for this country to stand up and get back on track with morals and values. I am an avid supporter of the right to immigrate to this country, but if you or your parents did so illegally, then you should be deported. I know that is a tough stance, but if illegals are allowed to prosper for breaking the law, then why should any of us be held accountable for our own actions? Obama is completely wrong on this and it is very transparent that he is only doing this to shore up the latino vote in November.

      Thank you for serving our country in the way that you have. But seriously, out of everything in this country to sadden a veteran, this is what you've decided to champion. You've decided that this action by the President to help innocent (they didn't break the law, their parents did) youth survive in the only country they know and love is where you'll make your stand. In addition, this action applies to youth who have served our country in the military. You're not saddened by the corporate greed shown by Enron and others. You're not saddened by the inept government reaction to the handling of Katrina and BP Oil, you're not saddened by the numbers of jobs being sent overseas just so we can pay less for our consumer goods. Again, as an American I thank you for your service. As a Christian, I would please ask you to reread the Gospel of Luke 10:29 and reconsider your position.

      Actually, what is sad is that you as a Vet should certainly know better and think only in terms of being more humanitarian in order to set a greater example about the military in this country when it comes to dealing with children. And for your information, it is the Children we are talking about who, through no fault of their own, ended up in this country and now support it. Where's your heart, Vet? Where's your compassion? Has all that military drinking, smoking, and other wayward things thwarted your way of thinking that much? Have you no compassion left for the Children who should not be faulted for being in this country? Great vet you are, Not!

        As another vet SaddnedVet sounds correct. This is not and should not be about children/young adults etc. This is about why was this done, and not getting to gain/prosper for doing wrong. SaddnedVet has an opionion on the other topics you listed I am sure but as many are prone to do you are adding several topics to this one. This article is not about most of what you listed. I feel bad that the parents of these children chose or were forced to do what they did but there are systems in place that must be followed. You and I and well most others have to follow the rules. Treat everyone the same or don't pretend to have standards.

    How do these kid get into the school system. The schools have always required me to provide birth certificate, social security card, immunization records and proof of address. Was always informed the child would not be allowed into school without this information.

But, it's "fair" to the children of illegals, not fair to anybody else in this country, and especially people on waiting lists to get in legally.     where will they find jobs? can we get them straight onto unemployment rolls to replace the americans who've given up looking for work and so are no longer counted as "unemployed"? will these folks still do the jobs "americans won't do"? like mason, roofer, drywall hanger, carpet installer, painter/glazier, line cook, dish washer, auto detailer, hotel housekeeping, office janitor, nanny, housekeeper, etc., etc.?

        My family members came here LEGALLY, by applying for entrance, enduring physical examinations, showing they had a sponsor, LEARNING THE LANGUAGE, NOT expecting the government to give them free healthcare, free food, free money (i.e. welfare), expecting their children to be taught in their native language in schools, etc. They were proud to apply to be Americans, and take the citizenship oath, when they had been here for 7 years. They were not like the ones now, that "only want a better life", without contributing to this country and what makes it great. The illegal aliens now, just want what the government will hand out.

      I totally agree. This has really mad me mad that Obama would do this. Instead he should have focused on keeping the illegals out rather then keep them in. Now it's just open season for more anchor babies to be brought over illegally. Might as well stop the border patrol program and just make it an open border now.

      However, maybe when these illegal kids start to work, they can find who their parents are and at least deport them by using the illegal kids. Unfortunately, I doubt this is the case. Way to lose votes there Obama, and gain popular votes by illegals who can't legally vote, or is that now going to change too?

      This is a simple one. Americians, want cheap labor. They are willing to turn a blind eye on illegals to get people to do the Jobs regular americans will not take and will not do. The children who came with them had little to do with this. They are the innocent in the scheme of things. In most states Public schools are funded by local tax's be it sales tax, property tax. All of which they pay.

      The ecenomic impact can also not be over looked. The fact the families work long long hours in often poor conditions for less pay, to provide to the public product and services at a reduced price is huge.

      SO yes you may be upset, but are you willing to work in the fields at below minimum wage for 12 hours a day 7 days a week? Are you willing to pay double for your produce if there families did not sacrafice for you?

      Give me a break this is nothing more than an Obama political ploy to try and win the Latino vote. If he was so compassionate about the issue he would've done something about it before the eve of the election.     Schedule a visit to Ellis island in NY and you will find that the parents of many of those writing in this forum come here illegally. They were boat people. The native Americans are the only true Americans. Everybody else is an immigrant. I am a descent of white European immigrants to the United States.

    I have a Master's in Mechanical Engg from US university, have been in this country from 2001 and paid taxes from Day 1. Still I am currently on a temporary VISA and can be asked to leave any time. What did I do wrong? Why can't I get work permit like these 1.7m guys?

      good question, but the answer is not in complain about this but rather supporting the obama administration in their quest to increase the acceptance of well qualified immigrants to this country (Which they are trying to do). But most of these people complain on this page will oppose that as well since that will steal the jobs from americans... it's like americans lost the understanding of a free market. A company will hire the best guy, doesn't matter if he is from this country or not

    Ok... First of all... I am first generation Legal immigrant, I am not white, and I voted for Obama.

    So... will someone please tell me how is this fair that these people who broke this countries law in the first place now can have work status, while students from all over the world who are highly educated (by us), want to stay in this country, could potentially be job creators (think google), can't work here without going through all kinds of hoops?

    What makes these people so special that they don't have to follow the same law that I and millions of other followed? Is it really true now that we reward law breakers? Even if when they were brought here, they were children, how is OK to benefit them? If I rob a bank, and leave all the money to my children, is that ok? is the government going to say ok... he is only doing this so his children could have a better life and let my children keep the money? Or really if enough people break the law, that becomes ok???? so if we all break the speed limit, that's ok????

    This is suppose to be a contry of law, without law, there will be chaos. and shut up about the law being unfair. There is nothing in the currenty law discrimiate against any race or country.

    For you supporters out there... Please tell me how is this fair to us LEGAL immigrants? and hundreds of thousands who are seperated from their family and still wait in line to come here?????

    meanwhile what about our kids who were born here? there are not enough jobs as it is.. ony 3 or 10 young people 18-22 had summer jobs this year.. realizing some humanity is required on this issue and it's a difficult thing these children (who are now of legal age to become citizens) should be required to apply for citizenship. Perhaps we should waive the fee for that or expedite the process but not making them legal doesn't help anyone or anything.

        Rick, You are the problem! Yes they are hurt people! Every single one of us AMERICANS! If you honestly believe the lies about picking your own lettuce you are a total MORON! It's been proven over and over these 'law breakers' don't do jobs that us Americans won't do, they only do them for less! So Joe picks lettuce for $10/hr, because he can't survive on less. When you add in the fee's, taxes, insurance, etc. His employer is paying over $15/hr out of his pocket. Pedro says I’ll work for $8/hr, without having those others fees because Pedro is illegal and therefore doesn’t exist. Even if Joe could work for $6/hr it would still be cheaper to pay Pedro under the table because of all the regulations business have. Some regulation is needed! We have just gone too far off the deep end on some of it though. If I could pay Joe $10/hr and only $10/hr I’d be happy to pay a legal worker! So we have a two part problem here. One, we have law breakers that come here expecting everything to be given to them. Don’t believe that go to your nearest ER sometime! Two, we have too much burden thrust upon business that forces them to look at ways to cut cost with an Illegal work force!

It's better to get these people on the books so they can legitimately pay taxes.       no kidding. U.S. is the only country that does not enforce existing laws. Federal laws even prohibits states to enforce laws to address Federal failures. I got nothing against any of these kids (latino or otherwise). However, I believe in enforcing the laws, and if the laws don't work, they need to be fixed. The only way for the country to work is that we STOP all illegal immigration (i.e. deport all illegals), and broaden legal immigration (i.e. all must come here legally)

    In many countries, foreigners are needed to fill gaps in the workforce...finally someone intelligent has found a way to make immigrants pay for the services they drain. He's how it works in places like Dubai...PAY for a work permit, PAY taxes – 10-20% higher rate than citizens, limit their rights as opposed to true citizens, deny automatic citizenship to future kids unless born of 2 LEGAL citizens and only offer citizenship to less than 1% annually. This setup sustains the citizens of that country to where ther are nearly NO taxes...LEARN FROM THEM

The effective unemployment rate (counting those who long gave up looking, etc.) is well over 15% and over 8% given even the pure fallacy of a statistic the gov't tracks. There are NOT enough jobs...and a president that is clueless as to how to get them (other than to heavily tax the small business who generate all of the real jobs in America).         We have a demand for very low and very high qualified jobs. Most unemployed are in the middle class that have a somewhat good education. Their jobs have been outsourced or lost due to the bad economy. They technically could get a less paying job, so the job is there but beneath them.
        It's not the presidents job to give people jobs, but rather create a good environment for growth, which our current president did, check your numbers. I don't see you blaming the banks for loosing all those jobs? Or the lawmakers that gave the banks the opportunity to ruin our economy?       I am an American citizen and I have cleaned toilets, picked fruit, done menial jobs just to make ends meet for my family while my husband served in the Armed Forces in Iraq and far away countries. Money was tight. We did what we had to do. So stop saying Americans are lazy! America needs to raise the wages to meet the expenses so we can keep our jobs here and not rely to illegals and every other "visitor" that can work for low wages having many in one household paying these outrageous rents and high prices. All we read about is how people make profits. It is about time for the greed to stop!

    I haven't read all the posts – but scanning quickly I see there are many for and many opposed to this. I am opposed sadly. Our economy is in bad shape and we need to tighten the borders and take care of our own. To all who say this is wrong because Americans still have a higher standard of living than many other countries – and open doors is what America is all about. I say "Do we really want to become like those countries?" Because I feat that is what will happen. I've read that for the first time the next generation (our children) will have a lower standard of living than their parents. The melting pot is full folks – not sure if that's forever or just until we get America pack on track.

        So you are saying I get to keep the money and send my Mom to jail.
        My point is that I should not reap rewards from my Mom if she broke the law to get them. Just like these kids should be rewarded for for their parents breaking the law.
        If they have an arguement with that, they should take it up with their parents. If we make it known that an act which breaks our laws will not be rewarded then the parents might think twice before doing it. They might even try to enter the US the correct way.

These are not fresh off the boat immigrants, these are students and workers who were brought here through no fault of their own, and are essentially American. They grew up here with me, they are my friends, they go to school with us, they go to school with your kids.         So imagine if your parents had brought you here when you were 2 or 3, (you know, before you can remember anything). You would be just as American as the kid next to you, maybe more so because his parents wouldn't take being an American for granted. Then you get to be a young adult and find out that any misstep, any contact with law enforcement and you could wake up in Guatemala with no money, no home, and no help. I find it shocking that so many people are unwilling to let others have the opportunity to succeed that they have by luck of birth. You are the kind of people that would let others die of thirst because you have dammed the river and now the water is "yours". I'll never agree with you about this. We all help each other and everyone will be better off and the selfish and distrustful do not succeed in the long run. That has been the way of the world for thousands of years.

      If the children are not deported, are you going to deport the parents? If so then you break up homes. If not then you provide yet another possible anchor for illegal adults. Furthermore, women in prison who have children either before their crime or after incarceration are not allowed to keep and raise their children in jail and they are not set free to go just because they have children. We are giving illegals greater rights than our CITIZEN criminals.

        The children are also here illegally, whether it was their parents that brought them or not. To use "the parents did it" as the basis for their stay means either 1. breaking up homes or 2. giving the illegal parents another anchor for staying. I wonder how many women have babies in prison and are allowed to keep them and raise them there for their full stay in jail (ie avoiding breaking up homes). If we don't break up the homes, then we are giving illegals greater rights than other CITIZEN criminals in this country.

    There are a lot of jobs out their that are open that many businesses need filled. People either don't want to work those jobs because it seems beneath them, are not qualified to do those jobs, are not willing/can't move to a new location for the job, and more. Some people are just picky, which is ok, but you can't say we really need more jobs when they are out there but people are not willing to take them.

      The employment rate is 8.3% AVERAGE. Some states alone are so much higher. There are a lot of jobs but who can afford to take a minimum wage job, when rents and food are so high. Apartments are charging rents over $1500 for a mere 2 bedroom. Not everyone can buy or rent a house. Most immigrants live 4,5+ more to a residence so they can afford rents like this. Average American has 2 to a place to live making it nearly impossible to afford living. Americans are not lazy, just being forced to concede because of low wages.

    My mother is German and has been living here for a LONG time. She has to spend hundreds, if not, THOUSANDS to Uncle Sam to renew her Green Card. How is this fair that my mother came over here the legal way and has to pay the government, while these illegal aliens get a free pass? They don't even have to pay a fee after they find work. It's simply pay your income taxes. Guess what, my mother pays her taxes as well, but has to pay extra to stay legal. Laws are in place for a reason! Follow them! No exceptions! Make their parents watch their children struggle in a country they are from and have no idea about! Maybe future parents will decide differently.

      uhm, i think you're exaggerating the numbers there, i have to renew my resident card and its only 450$ on the government website, every country has their own rules with the us when it comes to immigration but in general if your a perm resident then you go by the prices that are on the government website, she might be getting ripped off. And i pay taxes like any regular citizen to be a permanent resident, she can apply for naturalization if she wanted to "save" on the the perm visa, no? If illegals were really getting free stuff wouldn't we know were these places are at? I mean come on! sometimes I'm short of cash for groceries and would love to find out these "free" places unless your talking about religious charities than that is just a religious freedom, which is one of the few rights they have.

If the country's were reversed what do you think other country's would do, allow them to stay forever and drain the resources of the government which were supposed to have been used to help and take care of the citizens that had been paying into it their entire lives....     In reply to the first comment, it is the opposite of an insult to tax payers. These young people are ready and willing to work, which means they will pay taxes. Without this bill they will still work, but illegally and America won't have anything from it.

    Don't get me wrong I am not for illegal immigrants, but these kids are here not because they chose to, but because they were brought here. So let them do something constructive and work instead of ignoring them and further increasing their chance of become criminal.

    I fail to see how this could be an "insult to taxpayers" or any of the other bad stuff conservatives are spewing about it. These kids either are or will be taxpayers, too, as are their parents. My grandfather from several generations back was an illegal immigrant, too, and he also put up with Republican bigotry at the time for being Irish.

    You know, folks, if you'd put as much energy into helping your community feed the hungry as you do into worrying over whether your neighbor has "papers," your community would be a lot better place.

      Thank God for an American who thinks like that! No one looks back into their family history to see that their grandparents or greatgrandparents immigrated here illegally too! But hey, these people are different. Different? They want a better life, same as your Irish grandparents and most of the American population's past generations.
      My husband immigrated here as a child with his mother. He was ILLEGAL for several years but then his mom re-married an American ( to whom she is still married and in love with, if haters must know) and he got his papers through his stepdad. You know the first thing he did? Joined the US Air Force. Imagine that. He is still proudly serving, deploying, giving you freedom and calls this country his own, even though he lived in Brazil for the first 15 years of his life. Give these kids a chance. Hopefully their kids won't become immigrant hating hypocrites like most people.

        Apparently you should look into what executive orders can be. He is the President, this is a power that he has to make this order. Now lets say some random senator decides he wants to make this possible then that would be a violation of federal law. It's within his power. Regardless I don't see why everyone is making a huge fuss out of this. This is a country that was basically built by immigrants. They will be paying taxes. Most of these young adults don't know any other country other than the US. People keep claiming they will be taking jobs from "real Americans", the fact of the matter is there are jobs out there. Just maybe not the ones you want. I work two jobs myself and I am pretty sure if I wanted a third I could land one in a matter of a week. Perhaps it is a job that I am over qualified for, one that won't pay as much as I need. At least it is a source of income.

      Tell me, truly, why people like yourself so badly begrudge someone else an opportunity simply to live in this country? Do you think everyone should stay at the country they were born at–Canada, Europe, Germany, Sweden, Ireland? Or only America do you want to cross your arms and say "eww" to any newcomer? Is it a geological philosophy, or simply selfish bigotry-this is MY country and YOU cant come here...?

      I agree. If illegals are now going to be legal, and they are now the future of America, then La RAza had it right. They promised they would "breed them out" referring to legal citizens of the U.S. Anyone who doubts this can look it up.

        Did something change that I am unaware of that prohibits legal immigration? Why is it hypocritical to expect others to obey laws and then for some to be angry when laws are blatantly broken? I haven't heard to many people say that no one should be allowed in this country just that it be done legally. My wife is Hispanic, I have nothing against Hispanics. But I expect our government/leaders/people to be behind the idea that you just can't flood into this country and bypass established processes then be rewarded for it. I have served in the military for over 22 years now and I have been in terrible places helping other people but don't think the answer would be to bring millions from each of those countries and drop them on our door step. Or for that matter allow them to just enter this country whenever and however they wanted. Allowing these 1.7 million to have a mulligan is not helping to fix the problem. Mexico is the problem. Millions in bombs and troops for the middle east but we won't do anything about drugs and illegal's coming into our own country.

      Hate to burst your bubble but what is unemployment now? WE need jobs, then let the illegals that are now legals have them. WE have paid into the system for years, often times they have not.

        First off, there are jobs. Maybe not jobs that someone may want to perform, but jobs are out there. Perhaps they are under paid or labor intensive jobs that people don't wish to perform. What we need is more jobs that require college degrees for people that have college degrees. The majority of the young adults that will benefit from this executive order don't have any sort of schooling beyond high school. Without financial aid or loans, these people can't get further schooling. To get those you need to prove you are here legally. This will simply fill many of the job openings people for whatever reason won't take. It'll proved them a source of income, and pay in taxes. THIS IS GOOD!!!!!
