Program granting work rights for childhood immigrants begins Wednesday

By the CNN Wire Staff

Starting Wednesday, people who arrived in the United States as children and without documentation can apply to work without fear of deportation, the director of U.S. Citizenship and Immigration Services said Tuesday.

"This afternoon, USCIS makes available online the forms and instructions for individuals who will request deferred action for childhood arrivals," USCIS Director Alejandro Mayorkas told reporters in a conference call.

The announcement comes two months after Department of Homeland Security Secretary Janet Napolitano announced that people who arrived in the United States as children may request consideration of deferred action for a period of two years subject to renewal, and would then be eligible for work authorization.

The program, dubbed Consideration of Deferred Action for Childhood Arrivals, was created in June under an executive order signed by President Barack Obama.

"Deferred action does not provide lawful status or a pathway to permanent residence or citizenship," Mayorkas said Tuesday.

The $465 application fee will fund the administrative costs of the program, including a biometric check and issuance of a secure work-authorization document, he said.

Each request will be examined for possible fraud, he said.

The forms and instructions are posted at www.uscis.gov/childhoodarrivals.

As many as 1.7 million youths may qualify for the program, according to the Pew Hispanic Center, a project of the Pew Research Center.

When he signed the order in June, Obama said the changes will make immigration policy "more fair, more efficient and more just."

The shift on the politically volatile issue of immigration policy has elicited praise from Latino leaders, while Republicans reacted with outrage, saying the move amounts to amnesty - a negative buzzword among conservatives - and usurps congressional authority.

"This is not amnesty. This is not immunity. This is not a path to citizenship. It's not a permanent fix," Obama said. "This is a temporary stopgap measure."

Noting children of illegal immigrants "study in our schools, play in our neighborhoods, befriend our kids, pledge allegiance to our flag," Obama said, "it makes no sense to expel talented young people who are, for all intents and purposes, Americans."

The president declared that the policy change is "the right thing to do."

Under the new policy, people younger than 30 who arrived in the United States before the age of 16, pose no criminal or security threat, and were successful students or served in the military, can get a two-year deferral from deportation and apply for work permits.

Participants must prove they have been living in the country continuously for at least five years.

The change is part of a department effort to target resources at illegal immigrants who pose a greater threat, such as criminals and those trying to enter the country now, Napolitano said.

The move addresses a concern of the Latino community and includes some of the provisions of a Democratic proposal called the DREAM Act that failed to win enough Republican support to gain congressional approval.

Obama has been criticized by Latino leaders for an overall increase in deportations of undocumented immigrants in recent years. Last year, U.S. Immigration and Customs Enforcement removed 396,906 illegal immigrants, the largest number in the agency's history.

Obama and Napolitano have called for Congress to pass the DREAM Act, which would put into law similar steps for children of illegal immigrants to continue living and working in the country.

Republicans who blocked Democratic efforts to change immigration laws have condemned the move, with some calling it an improper maneuver to skirt congressional opposition.

Rep. Steve King of Iowa, a GOP foe of Democratic proposals on immigration, threatened in June to sue to stop Obama "from implementing his unconstitutional and unlawful policy."

Republican Sen. Lindsey Graham of South Carolina has called the decision "a classic Barack Obama move of choosing politics over leadership," while House Judiciary Committee Chairman Lamar Smith, R-Texas, has called the change a "decision to grant amnesty to potentially millions of illegal immigrants."
Others predicted the move will tighten an already poor job market for young Americans.

However, Democratic Sen. Dick Durbin of Illinois, who sponsored the DREAM Act, said it "will give these young immigrants their chance to come out of the shadows and be part of the only country they've ever called home."

Presumed GOP presidential candidate Mitt Romney said in June that the issue needs more substantive action than an executive order, which can be replaced by a subsequent president.

As president, Romney said, he would seek to provide "certainty and clarity for people who come into this country through no fault of their own by virtue of the actions of their parents."

Latinos make up the fastest-growing immigrant population in the country, and the Latino vote is considered a crucial bloc for the November presidential election.
A spokeswoman for a major Latino group, the National Council of La Raza, hailed the administration's move.

"In light of the congressional inaction on immigration reform, this is the right step for the administration to take at this time," NCLR spokeswoman Laura Vazquez said in June.

These people look good picking tomatoes, washing dishes and cleaning hotel rooms, why do they need education. With all the education, they will still have like a dozen kids before they turn 30 from various partners. If they get education, they will maximum become a manager of a grocery store.. what all the charade.. just keep them for picking tomatoes.

What about the thousands upon thousands of illegals who steal americans social securtiy numbers so they can get
a job. First they break our laws crossing our borders then they break laws again when they steal an americans ID.
They should be sentenced jail for 5 years and then deported as undesireables. Why didnt they just do it legally
apply for visa? I know because they dont want to wait or follow the rules. Our crime rate has skyrocketted because
of all the ms 13 and other gangs member who have come here. For all of them we should round them up each and
    every one and deport them.

What a lot of you people seem to be forgetting is that this country was FOUNDED by illegal immigration. We didn't ask the indians' permission before we moved in and started killing them off. Don't start throwing out the word "legal", either. Immigration only became legal after we made it legal (to the victors go the spoils), then decided that we could then determine who could, and couldn't come into the country.

      John,

Human race has evolved. We are civilized now and with time we are getting better. There are laws in place now, we need to abide by that. That is how we become a part of this society not by abusing it. We are a better race now and we can't go back in time. So essentially what I am trying to say now is that just as we can not go back in time and become a monkey, the same way we can not say that it is ok to break a law because we did it in the past.. get it??

John, you use your terms very loosely. The Europeans were conquerors not ILLEGAL IMMIGRANTS as you stated. Yes, to the victor comes to the spoils. So what's your point? Same way Mexico was founded. And now they control their own borders as well. The faith of the American Indians is sad. Too bad there couldn't have been a better outcome for them. Same for the Indians in Mexico and all over the Americas as well. But that is the way the history played out. And this is were we are now. Your rational in using how this country was found as an argument to justify illegal immigrations is bogus. We live in the present. Not on a past based on what happened hundreds of years ago. All countries in the world have a right to control their borders. As all civilizations have in the past. Before you could make an equal comparison between the first Europeans in this country and current illegal immigrants, then these illegals would need to enter the country by force and take over just as the Europeans had done. Afterwards, they can impose any immigration policy of their choosing. And only then can you make a reasonable comparison between the two populations.

The first immigrants didn't come to America looking for free rides. They expected to work hard and earn their way. If Free healthcare, food and housing were taken away from illegals, we would see a different type of immigrant coming to the US. We worked overseas for quite a few years and were required to have a work permit, a return ticket to our home country, we also had a Green Card which had to be renewed every other year. Our employers were required to pay for healthcare and housing. If you lost your job, you lost access to all the benefits and you had to leave! You couldn't afford to stay. It was immpossible to even have a bank transaction without your greencard that had a photo!

And again you're getting everything wrong, Mr. Lyons. No one is "regarding employment for Legal Citizens above Illegal aliens" as you stated. The new law only offers a POSSIBILITY for illegal children who grew up in America to look for and get employment. The law does NOT guarantee them a job. There is nothing keeping said Legal Citizens from getting jobs, and it won't be a quite restrictive new law that will change this. There are way too many lazy and broadmouthed Americans who prefer to live on food stamps and SS than to raise their behinds and WORK HARD like the people you're targeting do. Deal with it.

And what do you propose we do with them at this point? Deport someone who, through no fault of their own, was brought here and is just about as American as anyone else? Send them "back" to a country they never really knew and might not even speak the language of? Come on dude, have a little bit of empathy. I can understand making an argument for deporting their parents, and if they want to go too, fine. But saying you want to deport these people is just kind of crazy. How would you like like to be dropped off in a strange country where you don't know anyone and can't even speak the language, all because of something your parents did when you were young?

That is not the issue as the same argument can be made about majority white america voting for Romney. The problematic part is the country seems to have lost its center. Both parties are pandering to their political ideoplogies rather than meet in the center, sit accross the table and work out a common solution where both sides compromise. But this all or nothing approach is leading us down a slippery slope with nothing getting done.
I beleive that is the difference between politicians and statemen leaders. Politicians will tell you what you want to hear. Leaders will tell you what might be unpopular with you but the correct path to take for the greater good. LBJ is the best example that stands out in recent history.
In this case there needs to be a humane but practical solution for both short and long term and probably both sides might have to give up their ideological positions and meet somewhere in the center.
However in favor of fairnes the legal immigration backlogs should be first resolved before discussing illegal immigration. That should be the red line.

So what about the legal immigration backlogs? Most of them were created after Regan's amnesty and illegals were allowed ahead of the people waiting legally. Are these people again going to get ahead in line of them? Currently the the backlogs for people trying to immigrate the right way are running into 10 to 11 years. I beleive this will be the nail in the coffin of legal immigration of these people are allowed in line in front of them.
Legal immigrants you have a faster chance of getting your greencards if if you tear your passports and become illegal. Under our current laws if a kid came legally with parents and becomes 21 years of age then the residency application is terminated and either the kid has to leave the country or become illegal.
I am all for compassion but hey what about fairness. So breaking up families who immigrated legally is fine but not the other way.

The U.S. needs undamaged, able-bodied immigrants who want to work, study and succeed, if for no other reason than to dilute all the hate, mediocrity and senility that's keeping the country back. I was born in NY of Hispanic parents, and moving to Puerto Rico with them during the '70s was an experience in optimism, friendship and family love. Unfortunately the evils of the U.S. have ruined the island, but I see the same old values in the eyes of young immigrants who come to the 'states.

Oh yes, it's perfectly acceptable for foreigners to break our laws. But just watch what happens if we Americans break laws. Thus we citizens are becoming second-class citizens in our own country.

We have this double standard because treasonous bi-partisan interests want unending migration. Republicans want cheap labor, and Democrats want cheap votes. The goal of the Democrats, as outlined by their strategist Robert Creamer, is to import a new electorate easily manipulated voters who will give "progressive" Democrats a permanent lock on American politics.

Patriotic Americans have every right, and indeed the duty, to resist this outrageous assault against our nation's rule of law by right-wing and left-wing elites who aim to advance their agendas of greed and power.

Try looking for a job and being told you are over qualified. Companies won't hire because employers say if they pay us the amount job is requiring, person will get tired of lower wage and leave. If you went for the job in the first place, why, when you are so desperate for a job, would you quit? That is a kick in the teeth. When someone needs a job and is told they are over qualified, what does one do?Some companies are getting rid of employees who make good money, and hiring entry level people, so they don't lose there profits. Again greed is the bottom line carrying this country!

Short your resume, only include your last years, actually have several resumes depending the job you are trying to apply for, so you edit your resume eliminating the experience is not needed for the specific position. It is terrible they tell you that you are overqualified, but it is very common. Career Builder website usually has good articles that may help you.

People who voted by Obama made their choice trusting on the best for their country and its people. Don't blame on them. Many other Presidents had been selected and some people agreed with their choices, but many others didn't like them. The decision that Obama took was the correct. Helping these young people will help to have more educated society, that will be paying taxes and this does not have anything to do with taking other peoples jobs. When you really want to work, you are not sitting all day in front of your computer or T.V. blaming other people for your misfortune. Get off and look for a job, and if you have one, stay and take care of it.

This was required long ago... but I believe is too late now. I bet you there's a requirement somewhere in the law that will require applicants to have graduated high school. I'm 26 and I came to the U.S LEGALLY but going through high school I learned that many of my friends were not on the same boat and they will put that as an excuse to not do well in school. THEY HAD NO CHANCE TO CONTINUE EDUCATION OR WORK LEGALLY when at that time they have served the country the same way their group age had (by going to school and volunteering on local activities). I believe if we can steer them in the right direction there's a great future for this country.

Now they can receive free college under the Pell Grant. Then they can go to work and pay into social security and the tax system. Every one of them is a new consumer to the elite. Money is the whole motivating factor in pushing in all the illegals. The president doesn't care about Americans. He is interested in making a buck and getting the spanish votes. If the election were held today he starts off with 232 of the 270 electoral votes needed. Look yourselves in the mirror conservatives. You are NOT the party of Reagan. Exactly. The GOP sold their soul to the racist, inbred southern Ku Klux Klan members who felt betrayed by the old racist Democratic party when they began supporting civil rights, so they've become nothing more than a bunch of hateful, bitter, angry, racist craackers who are angry because they can't openly spit on/abuse darker-colored people in public and get away with it anymore. That's their "good old days".

So you have a party full of these uneducated (I dun gots none of dat fancy yanky book lernin) southern bigots, plus a bunch of Ayn Rand lunatics who believes that anybody who doesn't have the natural born ability (and lack of morals) to accrue massive amounts of wealth at the expense of others (or who isn't fortunate enough to have a rich daddy) is Lebensunwertes Leben. They've basically booted out the fiscally center-right/socially libertarian educated Northern base that used to make up the vast majority of the party, and openly ridicule them.

Even Goldwater hated them in the end. If Reagan had full control of his mental facilities I'm sure he would have as well.

Why are we giving work permits to unregistered foreigners when jobs are scarce and unemployment is at a nominal 8.5% in the US to begin with?
What is the reason for allowing foreigners who came here illegally to attend our colleges and compete with our citizens for hard-to-find financing and grants? This kind of move makes sense in a near-Depression economy how? Does ignoring the law as these people and their parents have done earn privileges now? Which laws can citizens get rewards for breaking?
Giving to others may be a fine thing to do, but not when your own are going without and struggling.
Since Obama has found this new power to create programs without the need for Congress, perhaps he could create a WPA and CCC to get Americans working. Other than that, this program will mostly add to the number of unemployed.

Now to address Pres Obama's move. It is nothing more than a great political move. It does nothing to allow illegals in and is not necessarily a path to citizenship.

For all you posters that state that we should deport them or that Romney will deport them on day one. How are you going to pay for this? Currently ICE has funds to deport only 400,000 illegals a year. Thus, they spend their time going after the worst

You're also forgetting that this new rule only applies to immigrants that were brought here as children. As a child, you have no control over the acts of your parents. They couldn't stop their parents from bringing them here. Essentially, they're victims. Having grown up in this country, through no fault of their own, I say we take it a step further, and just fast track them for citizenship. I agree with the author. They're already as American as we are, they're just forced to hide it.

I have two concerns about this. I'm all for giving people a chance at the American dream, but with two caveats.

    1) They buy into the system by paying taxes. If they don't have a SSN then we need some other TAX ID in the system for this purpose.

    2) They buy the American way of life by learning English, and pledging their allegiance to this country.

EVERY OTHER COUNTRY expects the same or more. The U.S. is not the immigration nazis. We are IN FACT very easy on immigration and it has been abused. The rest of the world needs to analyze it's own policies before pointing fingers at us.

This involves immigrants who were brought here as children. Do you think they should be punished because what their parents did was illegal?

I do not wish to reward for illegal behavior and do understand that some of these kids couldnt have helped being here as their parents gave them no choice. I say instead of just giving giving giving and not achieving nothing other than the fact that they can work without being arrested, make them work on the citizenship and become legal. 66. Way To Go Mr. President

You know, America used to be a country known for being quite humanitarian, one that knew that literally All Americans are comprised of all races, ethnicities, religions, backgrounds, etc. and took pride in and supported that. Now, we see super-whining coming only from Republicans who continue to show their true colors about being anti-Hispanic/Latino. Of course that can only translate into Massive Support and votes for President Obama who is only doing that which is right and humane! If they have been here that long, then Compassion and Opportunity should lead the way. This is not amnesty as the President has pointed out. However, the backward-thinking prejudiced Republicans would like to make it appear to be so with their fear that Hispanics/Latinos will only vote against them in November, and in the end, that will certainly prove to be the case! But then again the CONServatives have no one to blame but themselves. It's a real shame they could not support this Wonderful Plan and that the President had to issue an order to get it done. That is very telling about Republicans and Latino voters will certainly remember that at the polls! OBAMA/BIDEN 2012!!

I think you hit the nail right on the head. You my friend are a true American, unlike those who hide in ignorance and hatred, unlike those who are frightened by what they do not know. Let me remind everyone, for those of you who have grandparents and parents who are immigrants, this is quote they passed while starring down the horizon at lady liberty:

"Keep, ancient lands, your storied pomp!" cries she
With silent lips. "Give me your tired, your poor,
Your huddled masses yearning to breathe free,
The wretched refuse of your teeming shore.
Send these, the homeless, tempest-tossed to me,
I lift my lamp beside the golden door!"

This is America my friends! It always was and it always will be. I want Latinos to pay very close attention to this day, so that in the future, when we have all assimilated, that you remember that freedom is a God-given right, and not a gift that we Americans bestow to whoever we deem worthy. So that when the next immigration explosion happens, Latinos will be warm and embracing because wewill remember how we were treated when we sought a better life here in America.

This is all rooted in the ridiculous quota system that does not allow as many people across the border as there are market/jobs for them and the length of time and hurdles it takes to get a legal status (not necessarily citizenship(. These people come here because Americans offer jobs to them (in fact a lot of republicans do). Let's call it what it is, people who don't like immigrants are really racists who have issue with anyone who is not pearly white being in the country. That is the sad fact of it and why they will complain about this.

The sun shines for everyone, which means there is plenty of everything to go around for everybody. The shortage of jobs the govt talks about, are the same jobs they ship overseas, for tax and other purposes.

The resources the govt/people says illegals are draining, is a farce...eg: Illegals don't go to hospitals for fear of being deported. The schools the children are using, is being paid for by the employer who short changes the illegal worker from his/her true pay/worth.

The govt assistance (food stamps, or whatever) the illegals receive is for their children whom whether we like it or not, were born here, and whether we like it or not, are AMERICAN citizens.

Never do we hear the stories about the employers who hire/pick up these illegals (at home depot or wherever these illegals gather) for a job, then don't pay them, threaten to call ice as to avoid payment, then leave them stranded in the middle of nowhere.

Never do we hear of the employer who hires them, ever being prosecuted for such offense, or how the employer cheats Uncle Sam from all the taxes he/she saved by paying the illegal below minimum wage etc...wonder why we never hear these stories...go figure.

The hospital (by law) are required to treat all people regardless of citizenship status. Again, by law hospitals are required to treat people free if they are not able to pay. We all pay when the hospitals jack up their price for people with insurance, our insurance goes up to cover these costs. Illegals are not turned away and the waiting rooms are usually full of illegals. The hospital does not report these people to ICE. Where are you getting your information?

That sir is your opinion, the aquistion of the Mexican Territories by the US in the 1800's from Santa Ana for next to nothing left many Mexicans displaced, the economy in shambles and the friction of the government and its people in at a point in which they were never really able to recover from. As We see it today, the Mexican government is perceived as weak, it always has been since the shameful loss of the Mexican American War and the morally unethical sale of the south western territories of the US (Arizon, New Mexico etc.) Everyone knows without a strong central government, that economical success of a country would be hard to sustain. In essence, you can blame the US for Mexico's current condition and for the illegal immigration increase. One could argue, had the US never aquired those lands and disgraced the Mexican government in front of its own people, that Mexico would be a thriving economy. But that would be a stretch and an informed opinion, but not a fact! Seperate fact from opinion please!

Yes it is true that new mexico, Arizona, and Texas were taken from Mexico after The Mexican American war. However, I bet you didn't know this bit of history. Mexico was almost part of the United states after the Mexican American war. They almost forced mexico to become a part of the us. However, the individual that was in charge of peace negotiations felt that was going too far and settled new mexico, Arizona... Texas later became part of the US after having a disastrous experiment in being it own nation.
Anyway I disagree with Angels argument that mexico is weak because the US embarrassed it. It was embarrassed be cause it was already weak. Mexico waited too long to get out form the colonial yoke. Spain did not see Mexicans as citizens of Spain. Unlike Britain did with its American colonists. Instead they saw it as something to be exploited. Furthermore, colonial history left a legacy of corruption. If you wanted anything done, law wise you could always bribe someone. Hence, politicians in Mexico have taken bribes ever since. Corruption has harmful effect on a nation.

You can go back as far as you want and the entire world landscape will look different. Not a single group of people is where they were at some time in history. So let's deal with the now of it all.

I'm glad they want to be US citizens, but when does profiting from an illegal act get punished. I would give everyone of them citizenship if their parents leave the US. That is price they pay.

This law is just a bunch of BS to get more votes for Obama. I totally disagree with this law except for the poeple that joined the military. There are people that really want to live the american dream and go the correct path to get a shot at it. Sometimes it takes them years and now in a down economy we open the doors for 1.7 million workers to fill jobs that the poeple already living here need.

My son has been out of work for the past 16 months. As a family on the South Side of Chicago, we have been hit particulary hard with no work for our children (ages 16-22 yrs old). Glad to see that another 1.7 million ILLEGAL workers will now have a chance to compete with my son for work. Thanks Obama. FAIL

The illegal immigrants get more rights and privileges than our veterans who have fought for this country do. Makes me sick. I might have to vote Republican in Nov on this issue alone. You can't just hand the country away to people who have stood in line and earned their right to be here. Sickening behavior on Obama's part and on Congress for not reforming immigration. and not securing our borders.

Yeah, great – more diversity. At what cost to taxpayers and people who actually came here legitimately? Oh, forgot about that, huh? These kids will follow in the path of their single-mother parent: They'll have kids out of wedlock and lots of them. Then, they'll milk the system for every penny they can. Then, their offspring wil continue the fine traditional of illegal immigration, freeloading, and ripping off taxpayers. Great. America needs more of this, no doubt. ** eye roll **

For those who say our grandparents came here as illegal aliens – CHECK YOU HISTORY before making inane comments. The Immigration LAWS were not the same back then. With all the empty land we wanted and NEEDED new immigrants to fill up the land. So those people were not ILLEGAL.

Today our laws are different. We no longer HAVE all that empty land to fill so we are more selective on what people are to come in. Specifically we don't want criminals, drug cartel members, etc. We also want to set a limit on the number of people coming in each year. Those who do not apply and get authorization by our CURRENT LAWS are "illegal immigrants".

I can not believe the id iocy of our government in making this executive decision. For every law that some agency says they will not enforce, they erode the value of our ENTIRE LEGAL SYSTEM. If we can ignore this law of the land, why not other laws? Such as do not speed, do not steal, do not kill?
