What's next in Arizona immigration battle?

By Michael Martinez and Mariano Castillo, CNN

(CNN) - A legal chapter closes now that a federal judge has lifted an injunction on Arizona's "show me your papers" provision of its tough immigration law, but the legal combat won't end and will merely take a new direction, analysts and attorneys say.

At the same time, implementation of the law will heighten a wary relationship between police who must enforce the law and Latinos who allege it will inevitably cause racial profiling. The court's demand for evidence of such profiling is prompting Latino advocates to police the police and monitor arrest practices.

The controversial provision authorizes local police, while performing other state law enforcement duties, to check on the immigration status of people they stop for another reason. The federal judge in Arizona this week based her decision on a recent U.S. Supreme Court ruling upholding the provision, she said.

If people knew are unfair and antiquated the immigration laws are in this country they would realize why many people cross the border or enter the USA illegally. There is discrimination in our immigration laws. We need to revamp the entire immigration laws and systm

Sorry, but it doesn't matter why people sneak across the border............they know they are illegal! There is nothing about unfairness involved in this. The USA has laws that must be obeyed – and when you sneak into the country, you are offending those immigrants who are following the appropriate path and waiting to become legal. We cannot feel sorry for those of you who do this.....especially, since my (and many other peoples') ancestors did their paperwork and followed the legal path to enter the US.

The immigration policy needs to be revamped and the process needs to be done quicker. The current system is broken and messy, many legal ones ended up falling into cracks. My husband has PhD, I hold master – both in science – our lawyer hired by the company messed up badly, I ended up being 'illegal' and barred from the country for 3 years, leaving my family. Took me almost 10 years to get my legal paperwork so that I could start working and be a productive citizen. I have been on the other fence – and the community rallied behind us. We have the money, the education and the political and community support and yet ended up into legal battle with millions others – I can see so many others falling into the crack because of the current messy system. Revamp the laws, make it simpler and quicker.....

Laws that are unfair and make no sense will never be obeyed; never have been..and finally they will repealed or reformed. It is a matter of when, not if. Breaking such laws is needed to bring awareness to them and rally people of goodwill behind a good cause

The Arizona law cannot be implemented or enforced without racial profiling. It is impossible. There is no link between going through a red light or robbing a liquor store and immigration status. None whatsoever. The only way to do it is by looks, race, accent, dress, etc. And THAT IS RACIAL PROFILING, no matter how you dress it up.

ALE, when 90% of a group of lawbreakers are of one particular minority, from one nearby country, that isn't profiling. It's betting on a sure thing. I only CA had the balls to call a spade a spade and stop coddling and making excuses for the millions of lawbreakers flooding this state. By the way, you should talk to a few legal immigrants from that particular country. You will find that the legal immigrants are as much against any sort of amnesty or special treatment for the illegals as anyone.

Until America says enough is enough the illegal entry into the USA will continue. If you think Romney will be better than Obama think again. Remember Bush did absolutely nothing as all prior presidents have done. Regan tried to do something but presidents after did not enforce the laws he put into place. NO JOBS available would stop it in a heart beat. Putting the culprit that hires them into prison will even do more. Rent to them and you become a criminal yourself. Stop the FREE health care and make anchor babies the same nationality as the mother. I will vote for that how about you? Or better yet shoot a few as they cross the border into our country.

I would go further. Every US citizen (both parents must be natural born citizens) would be required to have a Federal ID card. This card would be required in order to make any and all purchases, apply for a job, rent a residence, receive any state or federal license, and basically live here in the US. Anyone here illegally (regardless of origin) would have to leave of their on volition. We are drowning in illegals who don't pay taxes, abuse public services, and commit crimes then return home to avoid prosecution. If you love illegals so much, then move to their country and see how that works for you!

      • ALE

The Card itself is not a bad idea. The reasons you present to advocate for it are a bunch of fat lies. Immigration both legal and illegal is at the lowest it has ever been. Illegals pay taxes just like everyone else in the USA who makes enough for it. 49% of US citizens pay no income taxes and that percentage among illegals is only a fraction higher.
They also use services at the same rates than Us citizens with the lowest incomes and are convicted of crimes at the same rates.
In essence, you don't know what you are talking about

First of all, immigration is a civil matter, not criminal. Second, if a blond robs a bank, then you know who did it, there is no discussion. Third, a person who "just crossed the border"can look like like anything plus you still have to prove they did it illegally. If you conclude they did so based on how they look, that is racial profiling and everything is wrong with it. There are millions of White Canadians, Europeans and Southamericans who have overstayed their visas for decades and it would not cross your mind to question their immigration status. Or it would but you would not dare because they are white.

pogojo I do know what I am talking about – IF a new born little citizen has no home, no food, no way to help himself. What do you think he/she can do? Mommie and Daddy go to the nearest welfare office wtih their little new American and give their sad story. The office is NOT allowed to ask if they are here illegally. The new born has a SS# assigned by the hospital where it was born. Then the free thing begin to be generated. That is the reason that so many pregnant women are coming across the border into those border states to deliver. One hospital in Texas had to close it's doors because the free births and caring for the new born's was a financial strain that it could not take. I hope to see in the future a law that makes that baby the same nationality as the mother. Problem solved or as said earlier just shoot them as soon as they cross. They are criminals. It would only take about two or so shootings. Problem solved!!.

The major problem with not arresting someone without papers it that the people who hire them, usually in the political arena fight so against it, that we have a nation full of people who we have no idea who they are or what they have in mind as far a terrorism to this nation. We have in place a process by which one can enter legally. It takes a little time but it is unfair to those who waited and came here legally. When a person sneaks into our country, violating our laws (fair or not) how can this person later be trusted to follow other laws that may exist in our country ??

By accepting illegal immigrants as residents of our country, we are condemning them to a life of being a second class citizen. The only way for them to be treated equally with citizens, is for them to EARN their citizenship, and become American citizens. The real racists here are people like ALE, those who think illegal immigrants should be GIVEN something, because that only condemns them to a lifetime of being second class citizens.

I know what I hope is next. Stop allowing babies born to Mexicans to become USA citizens. Stop giving them benefits after they have that little citizen. They do not belong in America unless they have been invited. Thinking of this nation as a home – how would you like it if some one came and stayed in your home without an invitation. You have to feed them, pay for their health care and house them. How would you like it?

Illegals don't necesaarily work in the fields, they take our construction jobs, waitress, hotel jobs...they are making minimum wages and some higher...if we need field pickers, there are plenty of prisons or jails, where we can get chain gangs to volunteer to work these fields. The owner pay the prisoners what they state pays them, less that $1.00 a day, if they work in the field they can get some of their sentences off, not talking about harden criminals. This would be a win/win situation. The farmers get their fields picked at low cost, the state gets paid by the farmer, the state doesn't have to pay prisoners...so what is the problem?

The problem is that was then, and this is now. Do we really need to be overrun by Mexico's illiterate masses? Or their families when they're granted amnesty? The downfall of America's education policy can be directly traced to the children of illegals, not legal immigrants. By and large we need educated people, not masses of uneducated. Every other western country has a points-based system, awarding immigration to those who a) speak the language; or b) are educated and can quickly assimilate. This country has been "Mexicanized", and not in the good way. This lawlessness is unsustainable.

When immigrants came to this country years ago (in the 20's 30's & 40's), they came to find a better life BUT they worked like hell to deserve it. They didn't take hand outs. They were proud people who were determined to learn the language and support their families and become Americans! Today, they come to take advantage of the system and they can, because we don't enforce the immigration laws. Big difference!!! Become legal, learn the language, and work to support your families and I will be happy to have you in this country!

We have never had an open border. The immigration service has existed for hundreds of years. All you have to do is apply for citizenship. We control how many come over the border. We always have and we always will.

You do not know what you are talking about. You cannot apply for citizenship unless you have been a permanent legal resident for 3-5 years. And to become a legal permanent resident there must be a legal avenue that applies to you. For 99.9999% of would be applicants, there is no such avenue. That is why they are illegals in the first place!

You are correct that you must be a legal resident in order to apply for citizenship. But there is a program in existence today, that would allow a non-citizen to enter the country legally, under a H-2A Temporary Agricultural Workers classification (for example) and yes, Mexico is a country that's on the approved list for this program. There are many other comparable programs that exist for different occupational skills.

Of course, to qualify for such a program you can't have a criminal record, and you must have some employable skill. But considering how badly some American industries need workers, I don't imagine that many qualified applicants would be rejected.

Illegal immigrants come to this country because they were unable to build a life for themselves in their home country. If they were unable – or unwilling – to do it in their country, they're not going to do it here, either. THAT's why their illegal immigrants. Our government has a policy, and it sounds like a fair one. All they have to do is follow it, and that's too much trouble for them. They'd rather rely on some whiny crybaby like you to call us racists because we don't GIVE them what they won't EARN.

That program stands alone, is expensive, time consuming, awkward and does not establish residence, only temporary work permit. Does not pay enough to make it worh for workers to go back and reapply all over again. Last but not least, it does nothing for people with other skills and experience other than agricultural work.
The system does not work. we need one that does, if you are serious about ending illegal immigration

It did not because our Federal Government refuse to enforce our laws. 99% of the American Citizens was it to stop and want those already here illegally sent back but it will never happen in my life time. There was no stability among the Indians. How would you like to have been in a small neighboring tribe of the Aztec, where the Aztecs would often come into your tribe and demand 20 men to sacrifice to their war god? Or how about the small tribes neighboring the Sioux, who were forced to ally themselves with the white man to prevent the Sioux from attacking?

These people cost our county billions of dollars a year, pay no taxes and breed like rabbits. We don't want or need more poor Mexicans here. Our economy can't sustain the continual hand-outs, while these slime send every dime they make back to Mexico. I have a real problem with that, especially when they then turn around and ask for and receive, welfare, food stamps, discounted housing and every other "free" benefit they can get their grimy hands on. These young adults are NOT blameless. Upon their 18th birthday, they should return home, apply for a visa and participate in the legal immigration process. Many of them would easily qualify for a student visa to attend college. If poor and uneducated, they would have a difficult time getting a visa. Either way, this is how the system works. To change this is UNFAIR to all those waiting in line. Millions of people are trying ti immigrate legally. What do illegal residents feel they have the "right" to cut in line ?

Maygyart..Returning "home" at 18 after being here since 1? ....You must be kidding !! THE USA is their home, just as much as it is yours or mine!!
They cannot "participate" in the process of legal immigration because there is no legal avenue for them to do so. Not even a waiver to the reentry ban. If they leave the US they are banned for reentry for 10 years, visa or no visa.
Student visas(for which they would not qualify anyways due to the reentry ban) are not immigrant visas. It is only temporary and only for school.
Most importantly...why should they go to school unless they want to? Why should that be a requirement for them when it is not for everybody else?
If they have been here since infancy, they are Americans, period, regardless of paperwork or school.
